On June 9, 2015, the D.C. Circuit Court of Appeals tossed out a suit against the EPA in anticipation of the proposed Clean Power Plan. There are many championing this as a victory for environmental policy, but the truth is the fight has only just begun.

In fact, according to the NY Times, "[The] litigants is already preparing to file a new suit one the [final] rule is put into effect."And unfortunately, the court never got around to commenting on the merits of the case leaving all of us in suspense with a cliffhanger ending to this story.

But, like most things in our political process these days, money is the motivator behind the pre-emptory strike against the Clean Power Plan, while Executive overreach and administrative interpretation is just the mechanism that gets the quarreling parties in front of a judge. For example, the Economic Policy Institute conducted a study to assess the long-term changes to employment numbers likely to occur switching from traditional coal burning power plants to renewable energy resources and natural gas production
Yet the world seems intent to move forward regardless of whether America can get behind climate change mitigation efforts or not.
